Introduction

These Terms and Conditions govern your use of services provided by Horizon Digital Solutions (ABN available on request). By engaging our services, you agree to be bound by these terms in full.

Please read these terms carefully before proceeding. If you do not agree with any part of these terms, please do not engage our services.

Services

We provide website design, development, and related digital services. The specific scope of each project is confirmed in writing before work commences. Any materials, deliverables, or features not expressly included in the written scope are considered out of scope and may incur additional charges.

Payment

A deposit may be required before project commencement to secure your project slot and begin work. Final payment is due upon project completion and prior to launch. All invoices are issued in Australian dollars (AUD).

Late or outstanding payments may result in project delays. We reserve the right to withhold delivery or launch until all outstanding amounts have been paid in full.

Revisions and Changes

Each project includes a specified number of revision rounds as agreed in writing. Additional revisions beyond the agreed scope, or changes that alter the original project brief, may incur additional charges at our standard rate.

All change requests must be submitted in writing. Verbal change requests will not be acted upon unless confirmed in writing.

Intellectual Property

Upon receipt of full payment, you receive ownership of the final website design and content created specifically for your project. We retain the right to display the completed work in our portfolio and promotional materials.

Any third-party assets used in the project (fonts, stock images, plugins) remain subject to their respective licence terms.

Third-Party Services

We may recommend or use third-party tools, platforms, or services in delivering your project, including hosting providers, domain registrars, and software platforms. We are not responsible for the performance, availability, pricing changes, or terms of service of any third-party service.

Warranties

We will use professional skill and care in providing our services. We do not warrant that the website will achieve specific business outcomes, traffic levels, or search engine rankings. Results depend on a range of factors outside our control.

Limitation of Liability

To the maximum extent permitted by law, our total liability to you for any claim arising from or related to our services is limited to the total amount paid by you for the relevant service.

We are not liable for any indirect, consequential, incidental, special, or punitive loss or damage, including loss of revenue, loss of profit, or loss of data.

Termination

Either party may terminate a project by providing written notice to the other. If you choose to cancel a project after work has commenced, you will be invoiced for all work completed up to the date of cancellation at our standard hourly rate. Any amount paid in excess of the work completed will be refunded.

Governing Law

These Terms and Conditions are governed by the laws of Victoria, Australia. Any disputes arising from these terms or our services will be subject to the exclusive jurisdiction of the courts of Victoria.
